Eye opener ang apat na araw na pre-trial hearing sa International Criminal Court (ICC). Hindi lang nasuma at nailatag ang estratehiya ng depensa ni Duterte, nasilip din natin ang desimpormasyon na nakatahi sa depensang ito.

  1. “No smoking gun.” Wala raw direktang kaugnayan ang patayan sa drug war kay Digong. Pero sabi ni retired Supreme Court senior associate justice Antonio Carpio, natural sa isang mastermind na panatilihing “layered” ang mga operasyon. Kaya nga “indirect co-perpetrator” ang taguri ng ICC kay Duterte dahil hindi siya ang kumalabit ng gatilyo. Pero dito pumapasok ang insider witnesses na binigyan niya ng direktang utos na pumatay.   2. Duterte is “old, tired, and frail.” ‘Yan ang excuse ni Kaufman nang sinabi niyang dapat i-excuse si Duterte sa pre-trial hearing. Peron noong February 16, 2026, sinabi rin ni Kaufman na si Duterte ang nagdikta ng waiver sa legal team niya. Ayon naman sa isang ICC-appointed panel of experts, “fit to stand trial” si Duterte, at inirekomenda ng experts ang shorter hearing hours and frequent breaks.
  3. “Nanlaban” narrative. We heard it over the span of six years: napatay ang mga biktima dahil sila’y pumalag o “nanlaban,” at “self defense” ang ginawa ng mga pulis. Sabi ng abogado ni Duterte na si Nicholas Kaufman, dokumentado raw ng arrest warrants, operational records, at firearms recovery reports na “legitimate police operations that escalated into exchanges of gunfire” ang mga indisente. Pero nagpakita ng katibayan ang Free Legal Assistance Group, na kina-copy-paste ang mga report — tulad ng “Putang ina, pulis ka” na paulit-ulit na nakasaad sa mga Tokhang pulis report na sinabi umano ng mga suspek bago “nanlaban.” 
  4. Legal ang mga operasyon kontra-droga. Hindi raw nagkulang ang gobyerno ni Duterte na ipaalala sa pulisya na sundin ang batas. Lumang diskarte na raw ’yan, sabi ni Prosecutor Julian Nicholls, dahil ’yan din daw ang ginawa sa dating Yugoslavia at sa Bosnia. Sabi pa ni Nicholls, ito’y SOP sa mga dokumento upang makalikha ng “veneer of legality, impression of legality, and to give his lawyers something to say when this day came.” At sa bibig nahuhuli ang isda — sa isang public broadcast ng government station, itinulak ni Duterte ang mga pulis sa extra-judicial killing: “’Pagka bumunot ng baril, patayin mo. ’Pag hindi bumunot, patayin mo rin.”
  5. Ito’y grand conspiracy vs Duterte. Ayon sa affidavit ng dating mga marine, nag-deliver daw sila ng cash kay dating senador Sonny Trillanes upang pondohan ang pagsasaliksik ng ICC sa bansa, at nagsilbi pa raw silang security escorts. Swak ito sa naratibong isa itong engrandeng kontsabahan at may malaking pulitikong nagpondo sa imbestigasyon ng ICC. Mga besh, hindi kailangang mamalimos ng ICC ng pondo sa vested-interest groups para umandar ang research! Sabi ni Deputy Prosecutor Mame Mandiaye Niang, may budget ang ICC galing sa member nations, at ‘yan ang ginamit sa probe at may resibo raw lahat ito. 
  6. Media creation lang ang DDS. Ayon kay dating PNP chief at ngayo’y Senador-in-absentia na si Bato dela Rosa, kathang isip lang daw ng media ang so-called Davao Death Squad (DDS). “It doesn’t exist,” sabi niya. Ano man ang tunay na pangalan, may nag-exist na grupo ng vigilante sa Davao noong mayor si Duterte na tumarget sa pinaghihinalaang kriminal, at walang pakialam kung sino man madawit, kahit na mga inosenteng kapamilya o kawani. (May kuwento si Lascañas ng in-ambush na pamilya na kasama ang anak.) Tumestigo rin si Edgar Matobato — under oath — na narekluta siya sa kill squad ni Duterte na tinawag na “Lambada Boys.”
  7. ‘Neutralize’ doesn’t mean kill. At hindi raw katumbas ng kill order kapag binansagang “high value target” ang isang tao. Maraming DDS codes na tinangkang basagin ni Kaufman, at kasama riyan ang “neutralize” at “high value target.” Nakasaad ang terminong “neutralize” sa memorandum mismo ni Bato dela Rosa sa pulisya, at ayon sa isang petisyon ng FLAG sa Korte Suprema, si Dela Rosa na mismo ang umamin na ang “‘neutralize’ means to kill.”
